In May of this year, the California Senate passed SB 1149. This Bill is called “The Public Right To Know Act”. It will likely be adopted by the Legislature and signed by the Governor. When this happens, California will bar defendants in injury or toxic tort cases from requiring confidentiality as a condition of settlement.
For years manufacturers of defective products, environmental polluters, and defendants responsible for creating unsafe or dangerous conditions have been able to hide the circumstances of injuries they have caused. When SB 1149 becomes law, the public will be able to learn about such things as malfunctioning tires, addictive medications, and toxic pollution.
When it becomes law, SB1149 will be a welcome development.
